TERMS OF USE

TERMS AND CONDITIONS

 

 

Article 1 - This contract concerns the rental of the gîte La Forge d'Espy – 4 Rue des Forgerons – 09220 Illier et Laramade. It is a house with 4 bedrooms, 2 bathrooms, 2 separate toilets, a kitchen, a living room equipped with a wood stove, a mezzanine living room, a private spa, with independent garden bordered by two rivers and a barbecue.

 

Article 2 - duration of stay: The tenant signing this contract concluded for a fixed period cannot under any circumstances claim any right to remain in the premises at the end of the stay.

 

Article 3 - conclusion of the contract: The reservation becomes effective once the tenant has sent the owner the deposit indicated on the front as well as a copy of the contract signed before the date indicated. A second copy must be kept by the tenant.

 

The rental concluded between the parties to this deed cannot under any circumstances benefit, even partially, third parties, natural or legal persons, without the written agreement of the owner.

Any violation of this last paragraph would be likely to result in the immediate termination of the rental at the fault of the tenant, the rental proceeds remaining definitively acquired by the owner.

 

Article 4 - cancellation by the tenant: Any cancellation must be notified to the owner, with acknowledgment of receipt.

 

a) cancellation before arrival at the premises:

the deposit remains with the owner. The latter may request the balance of the amount of the stay, if the cancellation occurs less than 15 days before the planned date of entry into the premises.

 

If the tenant does not appear within 24 hours following the arrival date indicated on the contract, this contract becomes void and the owner may dispose of his gîte. The deposit also remains with the owner who will request the balance of the rental.

 

b) if the stay is shortened, the rental price remains with the owner. No refunds will be made.

 

Article 5 - cancellation by the owner: The owner returns to the tenant all amounts paid in advance.

 

Article 6 - arrival: The tenant must arrive on the day specified in the time slot mentioned in this contract. In the event of late or delayed arrival, the tenant must notify the owner.

 

Article 7 - payment of the balance: The balance of the rental is paid 14 days before entry into the premises.

 

Article 8 - inventory: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure from the gîte. This inventory constitutes the only reference in the event of a dispute concerning the inventory of fixtures.

The state of cleanliness of the gîte upon the tenant's arrival must be noted in the inventory. In the minimum package included, cleaning of the premises in normal use is the responsibility of the owner. In the event of abnormal use of the premises, or exceptional soiling, the amount of cleaning costs will be re-invoiced to the tenant.


 

Article 9 - security deposit or deposit: Upon arrival of the tenant, a security deposit, the amount of which is indicated on the front of this contract, is requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned, less the cost of restoring the premises if damage is noted.

In the event of early departure (before the time mentioned in this contract) preventing the establishment of the inventory on the same day of the tenant's departure, the security deposit is returned by the owner within a period not exceeding not a week.


 

Article 10 - use of the premises: The tenant must ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises.


 

Article 11 – use of the land: Parking motorhomes and setting up tents is strictly prohibited in the car park or the gîte grounds, as well as cutting and collecting flowers or wood.


 

Article 12 - use of the spa: The spa is reserved exclusively for tenants of the gite listed on the attendance sheet. Children must always be under the responsibility of an adult. The good conditions for using the spa are in the welcome booklet available upon the tenant's arrival.


 

Article 13 - use of the barbecue: The tenants undertake to respect the safety rules relating to fire. The owner cannot be held responsible for any restrictions emanating from the municipality, department, region or state.


 

Article 14 - capacity: This contract is established for a maximum capacity of 8 people. If the number of tenants exceeds the capacity, the owner may refuse the additional people. Any modification or termination of the contract will be considered at the initiative of the customer.


 

Article 15 - animals: This contract specifies that the tenant can stay in the company of a domestic animal. The tenant must collect the droppings of his animals in the garden before his departure. In the event of non-compliance with this clause, the tenant will pay a fixed amount of 50 euros.


 

Article 16 - insurance: The tenant is responsible for all damage arising from his fault. He is required to be insured.


 

Article 17 - payment of charges: The minimum package includes water charges and electricity charges of 8 KW per day. Beyond these consumptions, charges will be invoiced at the price in effect at the time of rental. A meter reading will be taken upon the arrival of tenants.


 

Article 18 - disputes: Any complaint relating to the rental will be handled by the competent court.
